Terms and Conditions

1.About our services

We sell licenses for the use of automated trading software (Expert Advisor) for the MetaTrader 5 platform. We are not a broker, investment adviser, or fund manager. We do not receive, store, or manage your trading funds. All trading transactions take place in your own account, with the broker of your choice.

2.User accounts

• You must provide accurate information, including your name, email address, and mobile phone number, and update it if it changes.
• One email address and one mobile phone number may be used for only one account.
• Each account has a unique account code that you may provide when contacting our support team or partners.
• You are responsible for maintaining the confidentiality of your password and for all activity that occurs in your account. Contact us immediately if you suspect that your account is being used by another person.

3.License

• The license is personal, non-exclusive, and may not be transferred to another account or to another person. You are purchasing the right to use the EA, not ownership of its software.
• One license applies to one real account and one demo account, unless otherwise specified in the package you purchase.
• One MT5 account number may be bound to only one active license.
• The real account is the MT5 account number you enter at checkout. Ensure that the number is correct; the checkout form requires you to type it twice.
• As long as the EA has never been activated on that real account, you may correct the real account number yourself through the dashboard, for example in the event of a typing error.
• Once the EA is activated on a real account for the first time, the real account number is permanently locked and cannot be changed through the dashboard. The EA may only run on that real account.
• Transfer of a license to another real account may only be carried out through support, with our approval, and no more than once every 12 months. We reserve the right to refuse any request that shows indications of license misuse.
• A demo account is automatically bound to the first demo account that runs the EA. The account type (real or demo) is determined from MetaTrader 5 data, not from the information you enter. A demo account may be replaced through the dashboard no more than once every 30 days.

4.Validity period, trial & renewal

• The validity period of a paid license follows the package you purchase and is calculated from the date on which payment is successfully completed.
• The free trial is valid for 72 hours from the first time the EA runs, expires if the EA is not run within 7 days, and may be used only once, subject to the terms of the applicable partner broker.
• The Life Time package grants the right to use the EA without time limitation and without renewal fees. Updates and support are provided for as long as Phoenix Scalper continues to operate. If Phoenix Scalper ceases operations, we will provide a version of the EA that remains usable on the accounts registered under your license without requiring a license server. We do not guarantee that the EA will always be compatible with future changes to MetaTrader 5 or to brokers.
• We send reminders approximately 7 days, 3 days, and 1 day before the validity period expires via email and/or WhatsApp, and display a countdown of the validity period in the dashboard.
• Renewal is carried out manually through the dashboard. There is no automatic billing.
• If you renew before the validity period expires, the new validity period is added after the previous expiry date, so that no days are lost. If the validity period has already expired, the new validity period is calculated from the date on which the renewal payment is successfully completed.
• The license key remains the same after renewal. You do not need to reinstall the EA.

5.When the validity period expires (grace mode)

To protect positions that are currently open, the EA does not stop immediately when the validity period expires. Instead, it continues to operate normally for a 24-hour grace period, after which it enters grace mode:

• The EA does not open new cycles.
• Cycles that are in progress continue as usual, including the addition of layers where necessary, until the cycle is closed by a take profit or cut loss. Thereafter, the EA stops.
• This rule applies on a per-direction basis. For example, if a buy cycle has been closed, the EA does not open new buy positions, while a sell cycle that is still in progress continues until it is completed.
• During grace mode, you remain responsible for monitoring your account.

6.Pricing & payment

• Prices are charged in Indonesian Rupiah (IDR) through our payment provider. Prices in other currencies are provided for reference only.
• The EA file and license key are sent automatically to your email address after payment is successfully completed.
• Orders that are not paid within 24 hours will expire. While an order is awaiting payment, you may change the payment method; the previous payment number will be cancelled automatically.
• We may change our prices at any time. Price changes do not affect packages that you have already paid for.

7.Partner codes & promo codes

• Partner codes and partner links apply only to new customers, meaning buyers whose email address, mobile phone number, and MT5 account number have not previously been recorded in a fully paid transaction with Phoenix Scalper. The full terms are set out in the Partner Policy.
• A partner code may not be used for an account owned by the partner themselves.
• Promo codes apply in accordance with the terms of each promotion, including the period, quota, usage limits, and the types of customers eligible.
• We reserve the right to cancel any discount obtained through improper means.

8.Prohibited conduct

• Sharing, reselling, renting, or distributing the EA file or license key to any third party.
• Decompiling, reverse engineering, or modifying our software.
• Attempting to circumvent the licensing system, including running the EA on an account that is not registered under the license.
• Using our services for any unlawful activity.
• Violations may result in the license being deactivated without a refund.

9.Trading risk & limitation of liability

• Trading in forex and gold involves a high level of risk. You may lose part or all of your capital. Use only funds whose risk you are prepared to bear.
• We do not guarantee profits in any form. Past results, including those displayed in the Live Monitoring Account, backtests, and simulations, do not guarantee future results.
• All trading decisions, broker selection, EA configuration, and the associated risks are entirely your responsibility.
• To the extent permitted by applicable law, our liability is limited to a maximum amount equal to the sum you paid for the relevant license.

10.Service availability

We endeavour to keep the license server and dashboard operational; however, the services may be interrupted from time to time, for example due to maintenance or technical failures. We are not responsible for any disruption arising from your broker, VPS, internet connection, or MetaTrader 5.

11.Refunds

The terms for refunds are set out in our Refund Policy.

12.Suspension & termination

We may suspend or terminate your account or license if you breach these Terms and Conditions, or while a chargeback process is in progress as described in the Refund Policy. A license is permanently deactivated if a chargeback is granted.

13.Intellectual property rights

All EAs, trademarks, logos, designs, and website content are the property of PT Phoenix Scalper Teknologi and are protected by law.

14.Amendments to the Terms and Conditions

We may update these Terms and Conditions. The latest version will always be available on this page, together with its date of update. Amendments do not reduce the validity period of any package you have already paid for.

15.Governing law

These Terms and Conditions are governed by the laws of the Republic of Indonesia. Disputes shall first be resolved through amicable deliberation. These provisions do not diminish your rights as a consumer guaranteed under the applicable laws and regulations.
